Hello everyone,
My baby is 15 month of age and she started on December, after 2 months the DC called me and said you daughter can't be accepted from tomorrow because our license allows only 14 children.
Sounds like they had more than 14 before accepting my little princess.
The Short notice was a call on Monday, the President's day evening and they told us that they can't keep more than 14 and my child was the last one they accepted and that's the reason they want to get rid of her.
Can I report them?
Can I claim anything back from them?
They have charged me weekly rate + registration fee + pamper fee. I have also charged for Christmas and NewYear plus a week that the owner was in vacation. (I have to pay 14 days in a year for their vacation time per my contract.) but she went to that DC only for two months.

What does the contract you signed say? Are refunds given or does it say no refunds will be given?

I would politely ask them for my daycare tuition fee back for days unused from the first day she was not allowed to attend again and the diaper fee. I, personally, would give you back your registration fee if this situation happened (which is bizarre and not okay) but I am not sure if every place would. It can't hurt to nicely ask!

It sounds like your child was replaced and you were termed. You could always give licensing a heads up and let them know that the daycare informed you that they were over ratio at one point, but honestly I doubt they were.

If it is in your contract that they are not required to give you any notice then, yes, they can do that. If it's in the contract that they are required to give you some amount of notice (1 week, 2 weeks, 1 month, etc.) then that's what they should have given you and you can always contact a lawyer to see if anything is owed to you.

Without knowing the exact wording in your contract it's difficult to say if you're owed anything.

Are you paid up through the rest of this week? Next week? Did you pay a security deposit? Is the fee for diapers included in your weekly rate or do you give them, say, $20 every so often to buy a box?

What does the contract you signed say about refunds?

There really isn't enough information to know whether the daycare acted appropriately or not.

I have several part time kids enrolled and there are often times when I am unable to take them on certain days due to ratios. Full time (4-5 days) trumps part time ANY TIME.

This is something discussed with parents upon interviewing and enrollment.

A part time family may NOT have the space they need available to them if they aren't paying a full time rate.

I also don't really think there is anything to report to licensing. You can't very well report someone for NOT agreeing to go over ratios.

The return of fees and or deposits is entirely dependent on what the situation is and the written contract contents.
